Last January, during a hearing regarding the setup, Diaco pleaded the fifth over and over.
A special prosecutor appointed by Governor Scott determined Diaco and two other attorneys were part of a scheme to get rival attorney Phil Campbell arrested for DUI.
The Florida Bar found several ethics violations, and the FBI continues to investigate Diaco too.
But despite his troubles, Diaco is still the Chairman for the Tampa Hillsborough Expressway Authority, appointed by Governor Scott -- twice.
Which brings us back to Governor Scott, who never really answers the question.
"I expect everybody that gets appointed, every public official to live up to the highest standards," Scott said.
So Fox 13 reporter Gloria Gomez asked again.
“Do you plan on having him step down while he's going through all these ethic and criminal investigations?"
“Everybody that’s appointed, every public official, to live up to the highest standard,” Scott replied.
“But if he hasn't, what’s the next step for you?” we asked.
“I'm going to expect, like I expect from everybody else in the state, the highest standard. Thanks!”
The governor's office contacted FOX 13 later and said after reviewing Diaco's problems, he will not be reappointed by the Governor.
Diaco term has expired but he remains on the Expressway Board until the Governor appoints someone new.
