Attorneys irritated by rule-breaking potential jurors

TAMPA (FOX 13) -

Fourteen potential jurors faced the judge, for breaking his rule to avoid all news coverage of this case.

"I saw you and the defendant and his girlfriend, the mother of the child," said potential juror.

The potential jurors said they couldn't avoid it.

So Judge William Fuente asked them what they heard.

“I heard a baby was thrown out of a car,” one potential juror said, “I heard him say how he would go and kill them both."

Richard McTear's defense attorney became so irritated, he challenged one potential juror.

“As soon as you realized it was a news report, why did you listen to the facts instead of turning it off?” he asked.

“I did turn it off, I changed channels sir,” the juror responded.

“Except you describe a large number of facts,” the attorney countered.

“It was only a few seconds only,” the juror said.

McTear is on trial for the murder of 3-month-old Emmaunel Murray.

He's accused of kidnapping the baby from his mother's arms, then throwing him out of a car window as he drove on Interstate 275.

It happened five years ago, but many still remember it.

Among them are potential jurors who think McTear is guilty.

"I don't think it was a mistake in apprehending this guy, " said one potential juror that was eventually excused.
