Prosecutors say they are no longer seeking the death penalty for a Tampa mother accused of fatally shooting her two children.
The State Attorney's Office in Hillsborough County informed Julie Schenecker's attorneys Monday that it was withdrawing its notice of intent to seek the death penalty.
A spokesman for the State Attorney's Office said in an email that the overwhelming evidence of mental health issues would make a death sentence unlikely to withstand the scrutiny of the Florida Supreme Court.
Schenecker is scheduled to go on trial April 28 in the Jan. 27, 2011, slayings of her two children, 16-year-old Calyx and 13-year-old Beau.
Schenecker's lawyers have notified the court they intend to argue she was insane at the time of the killings.
