27-year-old Conrad Barrett is now charged with a federal hate crime.
On November 24th federal prosecutors say Barrett spotted an 80-year-old man walking down Danover street in Katy.
Barrett allegedly stopped his car, punched the elderly man, said knockout then drove off.
Barrett's attorney George Parnham says he's bi-polar and is heavily medicated.
"There is an extreme mental health issue that Mr. Barrett has experienced and is experiencing still," Parnham said.
Federal prosecutors say Barrett video taped the attack put didn't post it online.
According to court documents Barrett whose white, made racist remarks on videos and specifically targeted an African American for a knock-out game.
The elderly victim suffered a broken jaw and was hospitalized for four days.
