Parents Convicted Of Murder In Child's Starvation Death

There was emotional reaction Friday night to a guilty verdict in the starving death of a little boy.

It was not a first-degree verdict prosecutors and the family hoped for.

A judge instead found the parents guilty of third-degree murder, endangering the welfare of a child and conspiracy.

Those who loved Khalil Wimes and fought for him say his parents should never walk free, FOX 29's Shawnette Wilson reported.

"There is not a day that goes by that we don't – we all miss him," Lareine Nixon said.

She and her daughter, Alicia Wimes, broke down in tears leaving court Friday after a guilty verdict in the death of her 6-year-old grandson.

"I don't want to comment. I'm just saying we all miss him," Alicia Wimes said.

A judge found Khalil's parents, Tina Cuffie-Wimes and Floyd Wimes guilty of third-degree murder in the case.

Khalil had been living with other family members until the courts ordered him back to his parents, who beat and starved him to death.

"The most haunting thing for me would be that this child did not have to die this way," prosecutor Ed McCann said.

McCann said he's disappointed and that he believes they put forth evidence of a first-degree murder case.

Khalil was rushed to the hospital in March of last year, where he died. He weighed less than 30 pounds.

"He was whipped, he was beaten with belts, he was beaten with fists," McCann said. "He was horribly emaciated."

Defense attorney Mike Farrell also spoke with reporters as he left court.

"This case was probably as much involuntary manslaughter as it was first-degree murder, so I think the verdict is as enlightened as we as a society could have," Farrell said.

Nixon says she also blames the social system and family court for Khalil's death after they returned him to his parents despite evidence of neglect.

"They had 11 children, didn't raise any of them. And so it should have been obvious they wouldn't have done right by him," Nixon said. "And we asked specifically that Khalil not be the sacrificial lamb."

The mother and father face a maximum of 67 years in prison. Sentencing will be Nov. 26, Wilson reported.
