TAMPA (FOX 13) -

A 3-year-old child was shot and killed inside an apartment Tuesday night.

It happened near 22nd and Fletcher at the Avesta Apartments.

Investigators say they got the call around 7 p.m.

The boy's mother, father and uncle were inside the apartment, according to the Hillsborough County Sheriff's Office. The shooting happened in one of the bedrooms, they say.

The boy's uncle, 29-year-old Jeffrey D. Walker, has been charged with culpable negligence, a third-degree felony.

Investigators say he brought an unsecured 9mm handgun to the apartment and left it in a backpack. The child got hold of it, and it went off, investigators said.

Jadarrius Speights was taken to Florida Hospital where he was pronounced dead.

Detectives say Walker purchased the gun at a gun shop in the Tampa Bay area and does have a concealed weapons permit.

Walker is still behind bars waiting his first appearance before a judge. Officials tell FOX 13 that won't be until Thursday.
