A Polk County man is in custody on DUI charges, and deputies say he's in the country illegally.
Francisco Martinez, 30, is accused of driving drunk in his 2001 Ford Mustang in the Winter Haven area. Deputies say he and his passengers crashed on Rifle Range Road at 8th Street West.
Martinez lost control of the car and slammed into a tree, ejecting him. His two rear-seat passengers, Uriel Tolentino and Jesus Martagon-Cortez, were not wearing seatbelts but stayed in the vehicle.
Tolentino is in critical condition at Lakeland Medical Center. Martagon-Cortez is listed in stable condition. Martinez survived, but he had lacerations to his face.
A hospital toxicology report had Martinez at a .226 blood alcohol level.
Another man is being charged with lying to police, and deputies say it's because Martinez is in the country illegally. He has no known address. His friend, 56-year-old Bobby Vinton, lied on two separate occasions to deputies, telling them that he was driving the car.
However, witnesses all said Martinez was driving and was ejected from the car.
Martinez will be held until he is picked up by immigration officers.
No one else was injured in the crash.
