DeKalb school board files lawsuit against state

DeKalb County School Board members are fighting for their jobs, and they're using tax money to pay for it.  On Tuesday, the board filed a lawsuit against the state.  They want a guarantee they won't be dismissed from their jobs despite all the troubles facing DeKalb County Schools.

The lawsuit, filed in Fulton Superior Court, challenges a 2011 state law that would allow Governor Nathan Deal to remove DeKalb County School Board members at a State Board of Education hearing on Thursday.  

That news isn't sitting well with parents and lawmakers. Senator Fran Millar says he's "disgusted" by the board's decision to sue.  

"It shows it's all about them," said Sen. Millar.  "It's all about selfishness.  It's not about 100,000 kids."

FOX 5's Justin Gray also caught up with Governor Nathan Deal to ask him about the lawsuit and their effort to get a temporary restraining order to delay a Thursday showdown.  

"The longer that this is drawn out, the more protracted it becomes, the more the story becomes one that concerns people everywhere," said Gov. Deal.

DeKalb Co. Schools Superintend ant Michael Thurmond told FOX 5 this was a board decision, and therefore he's referring all questions about it to the board. Board chair Gene Walker said because it's a lawsuit, he's not talking either. He referred us to the board's attorney, but they did not return a call requesting comment.

The DeKalb County School Board is meeting on Tuesday afternoon and is expected to choose a new chairperson. The current chairman, Walker, is stepping down but will not leave his post on the board.
