Bubba's attorney: I took lie detector test

TAMPA (FOX 13) -

There could be another radio shock jock trial. Todd 'MJ' Schnitt wants another one in his bitter feud with his competitor, Bubba 'The Love Sponge' Clem.

Schnitt's attorneys filed a motion Monday alleging lawyer misconduct, but Clem's lawyers say it's a waste of time.

Clem's case lawyer, Stephen Diaco, who was implicated by Schnitt's team in the DUI case involving Schnitt attorney Phil Campbell, says he has taken a lie detector test and passed it, showing that he did not take part in any setup with police that resulted in Campbell's arrest.

Campbell left his briefcase in the car of a paralegal who worked for Diaco when he was arrested on the DUI charge.

Diaco said he never looked in Campbell's briefcase or never knew anything about the contents of it during the trial.

Clem's attorney Greg Hearing was quick to react to the news.

"That tells me what i suspected all along, that he has nothing to hide. That he is willing to answer questions about what happened that night, what his involvement was or wasn't that night. And I'm pleased that he's done that," he told FOX 13.

Diaco said the reason he pleaded the Fifth during a mini-trial about Campbell's DUI arrest was because he had little or no time to hire a lawyer and decided to simply say say nothing.

A jury cleared Clem of any wrongdoing in the first trial, and Schnitt says the jury missed the point.
