Winter Haven police decided not to file charges against a teacher at the Jewett School of the Arts.
Back in March 2011, at least five students told detectives that they followed the suggestion of their teacher and taped their mouths when they would not be quiet during a movie.
According to the police report, teacher Jeremy Henry said his suggestion was a joke, but he admitted it showed "poor judgment."
No charges were filed because police said there was no evidence that a crime occurred or that Henry showed any criminal intent.
Henry has returned to his job as a teacher at the school.
