An attorney for Kwame Kilpatrick says his client has suffered a serious knee injury behind bars and is asking the court to release the former Detroit mayor prior to his formal sentencing in a public corruption trial.
An attorney for Kwame Kilpatrick says his client has suffered a serious knee injury behind bars and is asking the court to release the former Detroit mayor prior to his formal sentencing in a public corruption trial.
DETROIT (MyFox Detroit) -
There was a new push Tuesday by attorneys to move Kwame Kilpatrick's federal corruption case out of the City of Detroit. The ex-mayor's lawyers argued the media has tainted any potential pool of jurors.
A story in Monday's Detroit Free Press titled "Ferguson holdout didn't tell whole truth" set off a firestorm in the Kilpatrick trial. Defense attorneys that have been complaining about potential jurors who have been less than truthful are now complaining about stories about jurors who concealed the truth.
Free Press and Fox 2 First Amendment lawyer Herschel Fink said there is nothing to worry about. The media has been more than fair.
"There is an effort to try to influence the jury, but not on the part of the media. On the part of, I think, the defendants."
The judge said she is concerned, but not ready to move the trial. Fink said there is no reason.
"There's been truthful reporting about Kwame Kilpatrick. If he thinks that's prejudicial, I can't help that."
As for the jury, it's looking good said attorney John Minock.
"This jury is more diverse than most of the jury panels we see in this court. How it shakes out in the end after all the challenges are made, we'll have to see."
On Thursday, there will be a hearing on whether or not this trial will indeed be moved. If the request for a change of venue is not granted, opening statements are scheduled to begin on Friday.
