The loss of 5 year old Jaden Justice was just too much for his mother to overcome Sunday.

"My baby is gone, I can't never hold my baby again," cried Justice's mother Erica Butler.

Saturday at the Mosley Motel in St. Pete Butler says her son was playing in the pool during a birthday party while his 13 year old sister watched him.

Investigators say Jaden was playing in the shallow end of the pool with other kids but somehow slipped down to the deep end undetected.

By the time someone saw him at the bottom of the deep end it was too late.

The little boy was taken to Children's Hospital where he was pronounced dead.

His father says the entire family is in pain.

"My son is very energetic, he just turned five the third of this month," said James Justice.

James Justice just moved his family from Maryland to Florida and have been living at the motel.

"We moved down here a month now to try to give them a better life, something different," said Justice.

Now he has to head back home to bury his young son, but at this point he's not sure how.

James Justice says they just don't have the money to get his sons body home.

"This is a hurtful feeling man, I don't even know what to do," said Justice.

For now Justice is looking for answers and right now he places at least some of the blame with the Motel.

"I think the whole thing was negligent, I don't think the whole situation was right," said Justice.

He says the pool was supposed to closed at 8 p.m., officers responded at about 9:45 p.m. Saturday night.

"If the fence was closed at 8 p.m. none of this would have happened," said Justice.

No one from the Mosley Motel was available for comment Sunday.

Justice says five year old Jaden was like any other playful, curious little boy.

Jaden's mother says he will certainly be missed.

"I don't know why, why that's all I want to know is why?" said Butler.
